Council received 7 submissions on the draft bylaw. Those wishing to speak in support of their submission will have an opportunity to do so at a Council meeting in September (date to be confirmed).

In reviewing the Speed Limits Bylaw 210, which came into force in 2004, Council is proposing to make some changes to the Bylaw.

The proposed changes include:

  • Additional clauses have been added to Section 4 to enable speed limits to be changed by Council resolution without having to amend the Bylaw itself.  All speed limits will be held in a Register (known as the Schedules), and therefore only the Register will need amending.  This change will remove the necessity to undertake the additional round of special consultation and hearings that is not required under the Land Transport Rule: Setting of Speed Limits Rule.  Extensive consultation will still be undertaken in line with section 7.1 of the Rule.
  • The urban traffic areas where the general speed limit of 50km/hr is applicable will be updated to reflect changes to areas where developments are planned including Nelson South and Marsden Valley.
  • A few minor technical errors in the urban traffic areas have been corrected as part of the review.
  • Four rural roads, previously unclassified have been allocated speed limits – Hollyman Rd, Hillwood Dr and Kanuka Rise are proposed for 50km/hr and Flowers Rd is proposed for 30km/hr.
  • 40km/hr variable speed limit zones are proposed for :-
    • Nile St (Nelson Central school),
    • Vanguard St (Victory Primary School),
    • Muritai St and Rawhiti St (Tahunanui School),
    • Nayland Rd (Nayland College, Broadgreen Intermediate and Nayland Primary School), and
    • Main Road Stoke/Rainui Rd (Stoke school and early learning centres).

The Statement of Proposal, Draft bylaw and maps

The Statement of Proposal includes:

(i) The draft Nelson City Council Speed Limits Bylaw (8/6/2011) No 210, including the Schedule A maps and indicative plans and data sheets to be read in conjunction with Schedule M

(ii) The reasons for the proposal; and

(iii) A report on the local authority’s consideration under section 155 of the Local Government Act of the problem being addressed by the proposal.

* Note that the draft bylaw contains underlining and strike-out text. This shows what's different from the existing bylaw -- the underlined text is NEW wording, and the strike-out text (a line drawn thru the words) is OLD wording that is to be deleted. This makes it easier to see just what's different to the existing bylaw.
