At its meeting on 7 April 2011 Council resolved to engage an independent Commissioner to hear and make decisions on submissions on proposed Council Plan Change 24 to the NRMP. A hearing was held on 15 July 2011 and the Council publicly notified its decisions on Saturday 5 November 2011.

Every submitter and further submitter was served with a copy of these decisions and  under Cl.14 of the First Schedule of the RMA any submitter or further submitter was able appeal a provision or matter that was the subject of their submission to the Environment Court within 30 working days.

No appeals were lodged in relation to Plan Change 24 and, at its meeting on 23 February 2012, the Council resolved to approve the plan change and make it operative on 12 March 2012.

Background

The Freshwater rules are being moved to an appendix rather than being repeated in each zone chapter. Plan Change 24.1 enables Freshwater rules FWr.26 to FWr.29 to apply in all zones (rather than the Rural Zone only). The rule related to effluent disposal fields (FWr.29) will now be able to be applied in cases where developers choose not to join up to reticulated services, as provided for in Proposed Plan Change 14 and the NCC Land Development Manual 2010. Proposed Plan Change 24 amends FWr.29 to more explicitly apply to all zones, and states that extensions to existing effluent disposal fields (as well as new disposal fields) require resource consent.

Plan Change 24.2 updates the water quality classifications in Appendix 28.4 following a review by the Cawthron Institute. The Cawthron report made 16 changes to the classifications that are included in the Plan Change.
