Former committee functions

1. The committee is responsible for the provision, operation and maintenance of recreation, culture and heritage, facilities and services.
2. The committee is the Council’s liaison with the community and government in respect of social issues affecting Nelson and oversees the Council’s Social wellbeing and Social Development services and initiatives.

Former specific delegations

1. To monitor and report of the achievement of service levels in respect to recreation, culture and heritage and social development services.
2. Power to set Council policy on matters relating to the provision, extension, reduction or modification of works or services supporting the functions set out for the committee, to the limit of the amount approved in the estimates and annual plan.
3. Power to set Council policies for the following services provided by the Nelson City Council: recreation activities, libraries, swimming pools, the marina, turf and landscaping activities, cemetery and internment services, cultural activities (including festivals and historic buildings), heritage and arts, employment initiatives, crime prevention, youth and positive ageing initiatives and to monitor their implementation.
4. Power to set policy on the levels of cost recovery of fees and charges for community use of facilities and parks and reserves falling within the function of this committee.
5. To receive reports and recommendations from the Regional Facilities Funding forum and to make recommendations to Council on any reports.
6. The Committee may recommend to Council proposals for bylaws when required to meet Council objectives for its recreation, culture and heritage facilities and services.
7. To recommend policies to the Council on Nelson City Council’s involvement and response to social issues consistent with annual plan and estimates.
8. To consider and if necessary recommend any actions arising in respect of the:

1. To recommend to the Council the amount and organisations to receive grants under the community grant scheme.
2. To recommend to the Council Community Contract funding agreements for community services.
3. Power to advocate on behalf of the Nelson community and lodge and present submissions to external bodies on policies and legislation relevant to the delegated responsibilities and functions of the committee.

Former committee functions

1. To develop policy and to monitor the effectiveness of such policy on matters relating to environmental, public health and safety, resource management, building and associated legislation administered by Nelson City Council. That legislation includes, but is not limited to:

• Resource Management Act, 1991
• Building Act, 1991; and from 30 November 2004 , as it comes into effect:
• The Building Act 2004
• Biosecurity Act, 1993
• Dog Control Act, 1996
• Fencing of Swimming Pools Act, 1987
• Food Act, 1981
• Hazardous Substances and New Organisms Act, 1996
• Health Act, 1956
• Impounding Act, 1955
• Litter Act, 1979
• Local Government Act, 2002
• Local Government Act 1974 (for those sections which have not been repealed)
• Maritime Transport Act, 1994
• Sale of Liquor Act, 1989
• and all Regulations made under the above, and the Amusement Device Regulations, 1978.

Former specific delegations

1. To recommend to the Council funding policies relevant to the functions of the Committee.
2. To recommend the need for, and to draft for the consideration of the Council, proposed bylaws relevant to the functions of the Committee. To monitor the effectiveness of such bylaws when promulgated by Council.
3. To recommend to Council policies or changes to existing policy affecting the regulatory environment the Council works within but outside the specific functions and delegations of the Committee.
4. Power to set policy on matters relating to the provision, extension, reduction or modification of works or services supporting the functions set out for the committee, to the limit of the amount approved in the estimates and annual plan.
5. Power to set policy in respect of all legislation and Council activities within the functions of the Committee.
6. Power to set policy in relation to regional planning issues, including co-ordination with other councils or requiring authorities.
7. Power to set policy in relation to environmental or public health matters including discharges, noise, natural and physical hazards, animals, dangerous and hazardous substances, food handling, liquor licensing, fencing of swimming pools, plants, vehicles, or premises maritime safety and control, and policy in relation to legislative or bylaw enforcement and the monitoring thereof.
8. To recommend policy in relation to the council’s functions for harbour safety and control, marine pollution and coastal management.
9. Power to hear, consider and determine submissions on policy issues in relation to building control and development, sale of liquor standards or controls, dog control, animal and pest control and management, hazardous substances management, and maritime safety.
10. Power to hear, consider and determine submissions on policy issues arising from the preparation, operation, change or review of the Nelson Resource Management Plan, or Nelson Regional Policy Statement, or to determine that commissioners may be appointed for such purpose in any matter where the Council is, or is perceived to be an interested party.
11. Power to set policy and determine actions to be taken by the Council as a Requiring Authority or Heritage Protection Authority.
12. To monitor the effectiveness and appropriateness of council policy and processes in respect of all the above matters and to undertake such amendments or changes as may be appropriate.
13. Power to set the priorities for the preparation or review of the Nelson Resource Management Plan (District and Regional Plans), or Nelson Regional Policy Statement under the Resource Management Act, 1991 and to confirm for public notification and submission discussion documents, strategies, variations and plan changes (but not the approval of variations or plan changes following consideration of submissions) – First Schedule, Resource Management Act, 1991.
14. Power to determine procedural matters relating to the preparation, review, or changes to a plan or policy statement under the Resource Management Act, 1991.
15. Power to set the priorities and to determine procedural matters relating to the preparation, review or changes to policy documents, strategies, codes, or other documents required under environmental health, animal control, building, and associated legislation relating to the functions of the Environment and Planning Committee, (excluding the Long-term Council Community Plan, Annual Plans and Reports under the Local Government Act, 2002).
16. Power to lodge and present submissions to external bodies on policies and legislation relevant to the delegated responsibilities and functions of the committee. Where submission time frames preclude consideration by the Committee; the Chair and Divisional Manager Planning and Consents and Manager Environmental Policy or Manager Consents are delegated power to prepare and lodge an interim submission not inconsistent with Council’s adopted policies and report to the Committee at the first opportunity.
17. Power to set levels of cost recovery of fees, charges, permits, licenses, and consents (other than those that are the responsibility of other committees) in accordance with the Council’s funding policy.
18. Power to set policy on matters relating to the provision, extension, reduction, or modification of activities supporting the functions set out for the committee, to the limit of the amount approved in the estimates and annual plan.
19. May resolve that any rule in any plan change or variation does not have effect until the plan change or variation becomes operative (s.20 Resource Management Act).
