The Council on 24 February confirmed the delegation of responsibility for navigation safety to Port Nelson, subject to resolution by the Directors of Port Nelson board and establishment of a formal agreement between Council and Port Nelson.

With this proposal, Nelson City Council delegates all navigational safety responsibilities to Port Nelson Limited through transfer of power under s650J Local Government Act 1974.

Background

Nelson City Council is responsible for looking after navigational safety within the coastal waters of the City.

Council recently reviewed the Navigation Safety Bylaws 218 and has for many years had an informal agreement with the Port Company (Port Nelson Ltd) to promote navigation safety and enforce the bylaws in the role of Harbourmaster. The Port Company has also taken responsibility for a number of navigation aids.

The present informal arrangements for harbour safety do not serve the Nelson community well. From various options to formalise harbour safety responsibilities and the carrying out of Harbourmaster duties, a delegation of powers to Port Nelson Ltd is most appropriate.

Under the Local Government Act this counts as a change in service delivery as the responsibility is being delegated to a Council Controlled Organisation (Port Nelson) from Council itself. That means Council is seeking feedback from the public on this proposal.

  2. Formal agreement over Harbour Master roles, duties, reporting
  3. Agreement over navigational aids (ownership and maintenance)
  4. Costs agreement
