A Bylaw of the Nelson City Council made in pursuance of powers contained within the Local Government Act 1974, the Local Government Act 2002, the Bylaws Act 1910,  and any other authority enabling the Council in that behalf.

1 Introduction

  1. The bylaw shall be known as the Nelson City Council Numbering of   Buildings Bylaw 2009.
  2. The Bylaw shall come into effect on the 2nd day of June 2009.

2 Revocation

On the coming into effect of this bylaw Bylaw no 204 being amendment 1/2002 to the Nelson City Council Consolidated Bylaw 1992 shall be revoked.

3 Definitions

City:

means the territory contained within the City of Nelson as defined in    Part 2 of schedule 2 to the Local Government Act 2002.

Road:

includes any street, or private street which provides for vehicular access to the property in question.

RAPID system:

means Rural Address Property Identification system under which street numbers (also called emergency services numbers) are allocated to rural properties. The system determines the number of a property by dividing by 10 the distance which the property is from the start of the road on which it is situated. Odd numbers are allocated to properties on the left hand side of the road and even numbers to properties on the right hand side.

4 Numbering of buildings

  1. Where the Council, in exercise of its powers under section 319B of the Local Government Act 1974, has allocated a number to any area of land on which a building is located, or to any building or separately occupied part of any building within the City, the owner or occupier thereof shall display the number allocated in a position whereby such is visible from the road.
  2. Where the Council changes the number allocated, the said owner or occupier shall display the changed number in substitution for the existing number, at the earliest opportunity, but in any case no longer than one month from being advised of the change.
  3. Where any numbers marking any area of land on which a building is located or any building, or part of a building are obliterated, defaced or removed, the owner or occupier shall restore or replace the said numbers at the earliest opportunity, or within such period as the Council might direct.
  4. Where any property is zoned for any residential, commercial or industrial purpose under the Nelson Resource Management Plan a number shall be deemed to be visible from the road if it is affixed in accordance with the following:
    1. If affixed to the building, part of the building or other structure associated with the building at or on the street boundary, including on a sign board at the street boundary of the property, the height of such numbers is no less than 50mm.
    2. If affixed to the building, part of the building or other structure associated with the building, other than at or on the street boundary, the height of such numbers is sufficient to enable them to be read from the road.
  5. Where any property is zoned for any rural purpose under the Nelson Resource Management Plan a number shall be deemed to be displayed in a position visible from the road if it is of a size and type, and affixed in a position at the entrance to the property, which conforms to the standards adopted in respect of the RAPID system.

5 Enforcement

Where any person fails to display the street number so allocated by the Council, and continues such failure after being advised by the Council of the requirements of this bylaw, the Council may take such steps as it deems appropriate and necessary to cause the number to be displayed and shall recover any costs incurred in doing so as a debt from the owner or occupier of the property concerned.

 The foregoing bylaw was duly made by the Nelson City Council at the Ordinary Meeting of the Council held on the ......day of ................... 2009.
