Bylaw 210 Speed Limits

The Nelson City Council, in pursuance of the powers and authorities vested in it by the Local Government Act 1974, the Local Government Act 2002, the Bylaws Act 1908, and the Transport Rule: Setting of Speed Limits 2003, hereby makes the following Bylaw:

1. Short Title and Commencement

  1. This Bylaw may be cited as “The Nelson City Speed Limits Bylaw 2004 (No. 210)".
  2. This Bylaw shall apply within the City of Nelson.
  3. This Bylaw shall come into force on the 24th day of December 2004.

2. Interpretation

'City' means the territory contained in the City of Nelson as defined in Part 2 of Schedule 2 to the Local Government Act 2002.

'Holiday Speed Limit' means a maximum speed limit set under this rule that is in force 24 hours a day for a specified period, or periods.

'Km/h' means kilometres per hour.

'Permanent Speed Limit' means a maximum speed limit set under this rule, that is in force except when a holiday, variable, minimum or temporary speed limit is in force.

'Road'

  1. includes:
    1. a street; and
    2. a motorway; and
    3. a beach; and
    4. a place to which the public have access, whether as of right or not; and
    5. all bridges, culverts, ferries and fords forming part of a road or street or motorway, or a place referred to in (iv); and
    6. all sites at which vehicles may be weighed for the purposes of the Land Transport Act 1998 or any other enactment; and
  2. includes a section of a road

'Rural speed limit' means a speed limit of 100 km/h

'Special event' means an event held over a short and defined period which would involve a significantly different use of a road to the extent that the permanent speed limit or the prevailing holiday speed limit would not be safe.

'Speed limit' means:

  1. the maximum speed at which a vehicle may legally be operated on a particular road, but does not mean the maximum permitted operating speed for classes or types of vehicle specified in any Act, regulation or rule;
  2. for a minimum speed limit, the minimum speed at which a vehicle may legally be operated in a specified lane of a road;
  3. an urban, rural, permanent, holiday, temporary, variable or minimum speed limit

'Temporary speed limit' means a speed limit that is in force for a period of less than six months and is set under this rule.

'Urban speed limit' means a speed limit of 50 km/h

'Urban traffic area' means an area designated under this rule that consists of one or more specified roads or a specified geographical area, to which the urban speed limit generally applies.

'Variable speed limit' means one of several preset alternative speed limits that may be in force for a particular road depending on the presence of specified conditions at that time, and that is set under this rule.

3. Speed Limits

The roads or areas described in the schedules specified in 4 hereto, or as shown on any map referenced in a schedule, are declared to have the speed limits as specified in the said schedules.

Notwithstanding the speed limits set within the said schedule the Council may, set a temporary speed if it considers that:

  1. There is a risk of danger to the public or to a person working on or near a road, or a risk of damage to a road; or,
  2. It is necessary for the safety of a special event.

Such temporary speed limit shall be set by installing signs in accordance with an approved traffic management plan, and in accordance with Section 5 of Land Transport Rule “Setting of Speed Limits 2003”.

Note

The speed limits shown for state highways within Schedule ‘A’ are not part of the Speed Limits Bylaw (No 210). Reference should be made to the “Transit New Zealand Speed Limit Bylaw for Speed Limits on State Highways”.

4. Schedules

All schedules are detailed below.

Schedule A: Urban traffic areas

Schedule B: Roads that have a speed limit of 20 km/h

Schedule C: Roads that have a speed limit of 30 km/h

Schedule D: Roads that have a speed limit of 40 km/h

Schedule E: Roads that have a speed limit of 50 km/h

Schedule F: Roads that have a speed limit of 60 km/h

Schedule G: Roads that have a speed limit of 70 km/h

Schedule H: Roads that have a speed limit of 80 km/h

Schedule I: Rural Roads – Roads that have a speed limit of 100 km/h

Schedule J: Roads that have a holiday speed limit

Schedule K: Roads that have a variable speed limit

5. Repeal

The Nelson City Council Bylaw No. 198 is hereby repealed.

6. Promulgation

This Bylaw was made by the Nelson City Council at a meeting held on the 16th day of December 2004

Schedule A: Designated urban area

The roads within the area shaded in green on Schedule A have a speed limit of 50 km/h except for those roads shown as having different speed limits and as detailed within the following Schedules B – I.

The 50km speed limit on all roads shown as being within the Designated Urban area was set by “The Traffic (Nelson City) Notice No 1 1992 (No 114 page 2526).

Schedule B: 20 km/h

The authority by which the speed limit was set is the Nelson City Council Consolidated Bylaw 1992-Part 3 Reserves.

All the roads within the following reserve areas:

  • Branford Park
  • Brook Motor Camp
  • Isel Park
  • Maitai Motor Camp
  • Maitai River Reserves
  • Marsden Cemetery
  • Rutherford Park
  • Saxton Field
  • Trafalgar Park
  • Tahuna Sands Reserve
  • Tahunanui Motor Camp
  • Wakapuaka Cemetery

The authority by which the speed limit was set is the Nelson City Council Consolidated Bylaw 1992-Part XVII Water Supply.

All the roads within the following reserve area: Maitai River Waterworks Reserve

The authority by which the speed limit was set is the Nelson City Council Recreational Marina Bylaws 1994.

All the roads within the following reserve area: Nelson Marina

Schedule C: 30km/h

 

Schedule D: 40 km/h

The authority by which the speed limit was set is the Nelson City Council Speed Restriction - Bylaw 1998.

Whakatu Road Link, 114m south of the Beatson Road Roundabout to the Whakatu Drive / Annesbrook Drive Roundabout

4. Road name

Waimea Road, 300m north of its intersection with the northern end of Beatson Road to a point 130m West of
Tuckett Place.

Schedule H: 80 km/h

The authority by which the speed limit was set is the Nelson City Council Speed Restriction Bylaw 1998.

  • Main Road Stoke from Dryden Street South to the southern Boundary of the City
  • The Glen Road from State Highway 6 to Athol Street

Schedule I: 100 km/h

The authority by which the speed limit was set is the Nelson City Council Traffic (Nelson City) Notice 2000.

Link Road from Whakatu Drive to a point 60 metres from Whakatu Drive.

Schedule J: Holiday Speed Limits

No holiday speed limits have been set at this time.

Schedule K: Variable Speed limits

Location: The Ridgeway (Refer Schedule K1)

From 132 metres south and 151 metres north of the kea crossing between number 23 The Ridgeway and the Enner Glynn School

and

30 metres west along Baigent Road from its intersection with The Ridgeway

Duration

On each school day 8.20am to 9.00am and 2.55pm to 3.25pm.

Amendment No 2

Amended Speed Limits – Cable Bay Road and Nayland Road / Saxton Road West

The NELSON CITY COUNCIL, in pursuance of the powers and authorities vested in it by the Local Government Act 1974, the Local Government Act 2002, the Bylaws Act 1908 and the Transport Rule:  Setting of Speed Limits 2003 hereby makes the following Bylaw.

1 Short Title and Commencement

  1. This Bylaw may be cited as “The Nelson City Speed Limits Bylaw 2004 (No. 210) – Amendment No 2.
  2. This Bylaw shall come into force on the 1st day of March 2006.

2 Speed Limits

  1. Schedule E to the Parent Bylaw is hereby amended under the “Road Name” “Cable Bay Road” by changing the words under “length” to read;

    “From Pepin Island to a point 2.55km generally south from the concrete ford”.
  2. Schedule G to the parent bylaw is hereby amended by the deletions of “Nayland Road” and “Saxton Road West” from under the “Road Name” together with the words corresponding to these two roads, under the words “length” and “Authority by which the speed limit was set”.

3 Promulgation

This bylaw was made by the Nelson City Council at a meeting held on the 15th day of December 2005.

Amendment No 3

Amended Speed Limits – St Vincent Street / Jenner Road

The NELSON CITY COUNCIL, in pursuance of the powers and authorities vested in it by the Local Government Act 1974, the Local Government Act 2002, the Bylaws Act 1908 and the Transport Rule:  Setting of Speed Limits 2003 hereby makes the following Bylaw.

1 Short Title and Commencement

  1. This Bylaw may be cited as “The Nelson City Speed Limits Bylaw 2004 (No. 210) – Amendment No 3.
  2. This Bylaw shall come into force on the 1st day of November 2006.

2 Speed Limits

  1. Schedule D to the Parent Bylaw is hereby amended by adding the following:
    1. After the Road name “Harbour View”

      Jenner Road – from its junction with St Vincent Street to its intersection with Murphy Street; and
    2. After the road name “Russell Street”

      St Vincent Street – from its intersection with Totara Street to its junction with Jenner Road.

3 Promulgation

This bylaw was made by the Nelson City Council at a meeting held on the 18th day of October 2006.
